BRIGHT ECOLOGY MUSEUM: TERMS OF SERVICE

 

The Terms, as detailed below, apply to https://brightecologymuseum.com and other BEM-related sites, apps, communications, and other services that state that they are offered under the set of these Terms, including offsite data collection for those Services/functions, and with BEM plugins (if any).

 

This platform, BRIGHT ECOLOGY MUSEUM (hereinafter ‘BEM’), at present hosted with web domain www.brightecologymuseum.com, is an initiative owned and operated by the Satya Saroj School of Eco Excellence, a non-profit educational constituent of Vishwaroopam - The Collaboratory. The platform's digital architecture and BEM Decodes media infrastructure are strictly powered by Bright Ecology Studio & Parilay Resonance Labs. This digital platform is a not-for-profit, purely educational, and philanthropic service. In this section, “we”, “us” and “our” refer to BEM and the Satya Saroj School of Eco Excellence.

 

1. Mission and Service Scope

BEM has a mission to take the message of everyday ecology, eco-art, and culture to avid learners, creatives, educators, media amateurs, and communities at large who are the preservers of ecosystems or the environment. Our services are purely philanthropic, educational, and charity-based, designed to promote and provide opportunity for our partners, collaborators, or visitors by enabling users to meet, exchange ideas, learn, and find opportunities in a network of trusted relationships through a variety of educational programmes and outreach of BEM.

 

2. Contributor Warranties

BEM contributors or users represent and warrant that they have all the rights necessary to grant a non-exclusive license for the content or own all of the contributed content, feedback, and personal information they offer to us. They also grant a non-exclusive license to BEM owner(s), which includes displaying or publishing to the public at large, globally. They own the submitted content and information, which is protected by their respective applicable intellectual property rights, or they have the right to share someone else's creative output if it is made available to them as part of the relevant authorization or whose exclusive copyrights they hold, and there is no third-party infringement of any intellectual property rights by the content.

 

3. Content Licensing & The Public Domain (CC0)

BEM contributors expressly grant a worldwide, permanent, irrevocable, transferable, perpetual, and sub-licensable non-exclusive, royalty-free license to Bright Ecology Museum (BEM) and its website(s) or social media applications to publish, post, reformat, copy, edit, modify including translation, adapt, reproduce, index/list information regarding, store, archive, make available, link to, distribute, syndicate, broadcast, webcast, publicly perform or display, process, and make derivative works of all such Content and the contributor's name, voice, and/or likeness as contained in the content. BEM may use this content without further consent, notice, or compensation in any media format or technology (now known or hereafter developed). BEM may, but is under no obligation, identify the contributor as the owner of such content.

 

Public Domain Designation: Where contributors explicitly designate their submissions for the public domain, they agree to abide by the Creative Commons Zero (CC0) license. Authors of such work accept they have waived all their rights to the CC0 Content under copyright law to the fullest extent permissible by applicable law.

Non-Commercial Designation: In certain specific request cases, content will be made available under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0) arrangement, which explicitly prohibits the use of the content for commercial purposes.

 

All content will be utilized by BEM abiding by these Terms and the Privacy Policy, made available for free and non-commercial third-party use subject to the limitations placed by law.

 

4. Institutional & Studio Intellectual Property Except for content contributed to BEM by third-party users in accordance with these terms, the services and all materials therein—including software, text, graphics, imagery, logos, service marks, patents, copyrights, photos, audio, videos, and music—are governed by two distinct ownership frameworks:

• 4.1 BEM Content: General platform design, educational text, and non-profit archival material are owned by BEM and its rightful users.

• 4.2 Studio Proprietary Content (The IPR Exemption): Any high-fidelity media (unless it is a CC0 or CC BY-NC-SA 4.0 content), its text , documentaries, or specific programs produced, branded, or designated as "BEM Decodes" (or otherwise explicitly credited to Bright Ecology Studio) remain the sole, exclusive, and commercial Intellectual Property of Bright Ecology Studio.

 

Users agree not to sell, license, rent, reverse engineer, decompile, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any BEM Content or Studio Proprietary Content unless expressly permitted. It is strictly forbidden to download, reuse, or monetize "BEM Decodes" content without executing a separate commercial licensing agreement directly with Bright Ecology Studio.

 

5. Content Removal

BEM can remove any content from its use at any time if it is flawed, has unsatisfactory quality for the purpose or relevance, or contravenes the Terms. Content can also be removed if BEM learns of any violations of the law through the content itself, links to third-party websites, or any unprofessional/unlawful/commercial promotions brought/published on this website.

 

6. Operational Transfers

Copyright transfer enables BEM or its affiliates to host, reproduce, distribute, communicate, and use contributed content. This includes saving it on computer systems or IT applications, publishing, performing, or displaying it. Rights can also be sublicensed to other users for limited purposes to allow BEM services as intended.

 

7. System Improvement

This copyright transfer is for the exclusive purpose of operating and improving BEM platforms, services, or functions, including allowing them to perform as intended and developing new features. This includes identifying patterns in data, using algorithms and automated systems, or conducting analysis as content is transmitted, received, or stored.

 

8. Duration and Institutional Access

BEM rights over the contributed content last for as long as such content is protected by intellectual property rights. Educational institutions and non-profit organizations are welcome to use BEM services, provided they do so through an authorized representative and accept these terms and the privacy statement.

 

9. Commercial Independence

As a non-profit organization, BEM adheres to its policy of not including donated or self-generated content in advertising for third-party products and services, including sponsored content. If such an incident occurs at the request of content copyright holders or without their knowledge, BEM accepts no responsibility for any violation of its Terms or Privacy Policy.

10. Third-Party Rights & The Commercial Firewall All information on the website is not solely owned by BEM; some may be protected by intellectual property or image rights belonging to third parties.

• BEM publishes select online content under a CC BY-NC-SA 4.0 arrangement, prohibiting commercial use.

• However, all text of the media designated as "BEM Decodes" or produced by Bright Ecology Studio is explicitly excluded from any Creative Commons or open-source licensing. This Studio Proprietary Content operates under standard, restrictive copyright ("All Rights Reserved") to protect the Studio’s commercial monetization rights.

 

11. Ethical Exclusions

Not all content on the BEM website is covered by a Creative Commons license. Certain work may not be shareable due to cultural sensitivities or because it would violate BEM's code of ethics.

 

12. Social Media Deployments

BEM content on social media sites can be used as long as it is not commercially linked or advertising. Uploading content to external sites grants site hosts permission for commercial use and does not qualify for BEM permissions.

 

13. The Systemic Mandates for Users and Contributors

BEM users, contributors, collaborators, partners, and hosts must specifically acknowledge the following operational boundaries:

 

• 13.1 BEM retains sole ownership of all intellectual property rights on the platforms/services to its own content or displays. It does not permit the removal, concealing, or modification of any of its branding without express permission.

 

• 13.2 BEM may access, retain, process, and use any information and personal data given in accordance with these terms and the Privacy Policy.

 

• 13.3 Contributors own their content; BEM holds only non-exclusive, royalty-free rights to it.

• 13.4 Content containing personal information is strictly subject to the BEM Privacy Policy.

 

• 13.5 The submission of ideas or feedback authorizes BEM to use and disseminate such ideas for educational or social awareness purposes without monetary or in-kind compensation.

 

• 13.6 BEM may update and format contributor content, such as by translating, resizing, layout changes, or eliminating meta-data.

 

• 13.7 Contributors will only provide information and content they have a legal right to share and that does not infringe upon the law or the rights of others. Profile information must be accurate.

 

• 13.8 BEM may mention user utilization of features, with or without their name or photo, to promote that feature within its services.

 

• 13.9 BEM reserves the right to alter, suspend, or stop any of its services permanently, temporarily, or prospectively, and makes no promises to store or display any shared information.

 

• 13.10 Use of others' content posted on our services is at the user's own risk. BEM platforms are not liable for the content or information of others.

 

• 13.11 Contributors authorize BEM to enforce violations of the sublicenses given to other parties for their copyrighted content, agreeing to assist in asserting rights in or out of court.

 

• 13.12 The views represented in third-party content do not necessarily reflect the views of BEM, its partners, affiliates, or promoters.

• 13.13 BEM does not endorse user contributions, nor does utilizing services create an employment, agency, or joint venture relationship.

 

• 13.14 BEM does not supervise or manage attendees at its events, nor does it vet events published on its platforms by Members, and it is not liable for their actions.

 

• 13.15 BEM reserves the right to restrict, suspend, or terminate platform access in the interest of public welfare.

 

• 13.16 Trademarks and logos used in connection with the Services remain the property of their respective owners.

 

• 13.17 Content shared under CC0 has no effect on patent or trademark rights. Representation of identifiable people, logos, or brands in CC0 Content may still require third-party authorization.

 

14. Disclaimer of Legal Liability

• A. The materials on the Bright Ecology Museum website have been carefully prepared, but we disclaim all express or implied claims to their accuracy. Materials are works in progress, and we reserve the right to make changes without notice. We are not responsible for any loss or damage that results from utilizing the materials.

 

• B. This website may include links to other websites offered for user convenience. As BEM has no control over linked external content, it is not responsible for third-party terms. Information on external websites is not sponsored by us, nor do we confirm its accuracy or endorse it.

 

• C. Services are provided on an "as is" and "as available" basis. BEM and its affiliates disclaim any implied or statutory warranty regarding uninterrupted, secure, or error-free service, including accuracy of data, non-infringement, or commercializability.

 

• D. To the maximum extent permitted by law, BEM and its affiliates will not be liable for lost profits, lost business opportunities, reputation, or loss of data, nor for special, incidental, consequential, punitive, or exemplary damages, unless superseded by a separate written agreement.

 

• E. BEM is exempt from liability regarding inaccuracies, omissions, interruptions, communication channel failures, theft, or tampering. BEM is not responsible for technical malfunctions related to telecom networks, servers, or hardware unless under direct BEM control.

 

• F. These exclusions from liability do not apply to death, personal injury, fraud, wilful misconduct, gross negligence, or broken material obligations, and only apply to the extent damages were foreseeably associated with enforcing these Terms.

 

• G. Except for the survival of legitimate rights and obligations (e.g., copyright holder rights to re-share), the Terms and Privacy Policy cease to apply upon termination.

 

15. Arbitration

In the event of a dispute relating to these terms, their enforceability, and/or change, BEM shall appoint an arbitrator. The arbitration will take place in Delhi, India, and will be conducted in English. The arbitrator's decision will be final and enforceable against both parties. This arbitration will be conducted in accordance with the Arbitration and Conciliation Act of 1996, as revised to the present. While adjudicating on any dispute, courts in New Delhi shall have exclusive authority under Indian Laws. If BEM or its affiliates do not take action to enforce a violation, it is not proof that they have relinquished their rights to do so.

The General Terms, Privacy Policy, and Do’s and Don’ts can be altered or modified from time to time to comply with the laws of the land or the platform's aims and purposes.
