BRIGHT ECOLOGY MUSEUM: OPERATIONAL PROTOCOL (DO'S & DON'TS)

 

BEM and its users, contributors, collaborators, partners, and hosts agree to the following systemic mandates:

 

I. OPERATIONAL MANDATES (The "Do's")


 

  1. Identity Verification: Provide accurate information to BEM and keep it updated as necessary, including the use of a real name on profiles and providing verifiable identity information.

  2. Legal Compliance: Follow all relevant laws, including but not limited to anti-spam legislation, privacy regulations, and laws governing intellectual property.

  3. Age & Guardian Liability: Comply with the actuality that, if applicable law requires users to be older than a certain age in order for BEM platforms to lawfully provide services without parental consent, parents or legal guardians of a minor or vulnerable adult are subject to the BEM Terms and Privacy Policy and are strictly responsible for their ward's or supervisee's activity.

  4. IP Termination Notification: Notify BEM immediately if there is a termination of protection or third-party infringement of intellectual property rights, as BEM will then be required to cease public sharing and display.

  5. Copyright Transfer Termination: Consent to transfer copyrights to BEM may be ended via written email or online communication, subject to acknowledgement by a BEM-controlled originating message. This termination is contingent upon the extent to which the content was already distributed, duplicated, or kept in backup systems for the duration necessary to execute removal.

  6. Professional Conduct: Employ the Services with absolute professionalism.

  7. Non-Commercial Parameters: The following activities utilizing BEM resources are designated as non-commercial in nature (unless proven otherwise by law):

  • Use in free-entry educational lectures or campaigns promoting lectures with no commercial connection.

  • Single classroom usage.

  • Use in educational, research-based, or informational websites unrelated to commercial endeavors.

  • Public display in areas with free admission, provided the use does not involve promoting a commercial product or service.

  • Use in a school setting or during official instruction for educational purposes.

 

II. STRICTLY PROHIBITED ACTIONS (The "Don'ts")

 

BEM strictly mandates that its users, contributors, collaborators, partners, and hosts do not engage in the following actions:

 

Identity & Asset Manipulation
 

  1. Misrepresentation: Create a false identity for BEM platforms, misrepresent their identity, create a profile for another real person, or undertake any act that is offensive or projects identifiable people in a bad light.

  2. Unedited Physical Distribution: Distribute unedited physical copies (posters, prints) of a photograph or film without first altering it.

  3. False Endorsement: Imply that persons or brands depicted in the imagery are endorsing their product.

  4. Commercial Resale: Share or sell the photographs and videos on other stock photo or wallpaper services.

 

Systemic & Intellectual Property Violations

5. Data Scraping: Create, support, or use software, gadgets, scripts, robots, crawlers, browser plugins, or any automated means to scrape the Services or copy profiles and data from the BEM platforms.

6. Security Circumvention: Bypass, override, or circumvent any access controls, use restrictions, or security measures imposed by the platform (such as limits on keyword searches or profile views).

7. Unauthorized Disclosure: Copy, use, disclose, or distribute any information obtained from the platforms (including other people's confidential information) without the express permission of BEM or its authorized representatives.

8. Third-Party IP Infringement: Violate another person's copyrights, patents, trademarks, trade secret protections, or other proprietary rights. Users may not reproduce or distribute published content outside of available sharing features without specific written consent from BEM, which may be withheld at its sole discretion.

9. BEM IP Infringement: Violate the BEM portal's intellectual property rights, including but not limited to: 

  • Utilizing the terms "BEM" or "Bright Ecology Museum" in any company name, email address, or URL.

  • Copying or distributing contents or materials unless they are the user's own copyrighted content. * Copying or distributing BEM applications or technology unless provided under open-source licenses.

 

Technological Malfeasance & Disruption

10. Destructive Code: Post anything containing destructive code, such as worms, computer viruses, spam, denial-of-service attacks, or gaming algorithms that could disrupt or burden the platforms.

11. Reverse Engineering: Decompile, disassemble, decipher, reverse engineer, or make any attempt to determine the source code for the Services or associated proprietary technology.

12. Unauthorized Affiliation: Imply or state an association with or endorsement by BEM without specific permission (e.g., posing as an authorized BEM representative or agent).

13. Unauthorized Monetization: Rent, lease, loan, trade, sell, resell, or otherwise monetize the services, connected data, or access to them without BEM's express written consent.

14. Deep Linking: Carry out deep linking to BEM platforms, services, or features for any reason other than to promote them.

15. Automated Interception: Use bots or automated ways to access features, add or download contacts, send or redirect messages, or access messaging functionality.

16. Competitive Tracking: Track the accessibility, effectiveness, or operation of these digital platform services for any commercial or competitive intent.

17. Interface Simulation: Practice "framing," "paralleling," "simulating," or any other method of replicating the appearance or operation of the services or platforms.

18. Visual Alteration: Alter or overlay the appearance of the services (for instance, by deleting, hiding, or making inaccessible any promotional content accessed from the platforms).

19. Breach of Supplemental Terms: Violate any extra terms supplied when users access particular services or functions.

 

The General Terms, Privacy Policy, and Do’s and Don’ts can be altered or modified from time to time to comply with the laws of the land or the platform's aims and purposes.
